Can I issue the letter myself?

Yes, you can issue the letter yourself.

However, in our experience, we have found that when our clients issue letters directly to the other party it is often ignored or not taken seriously.

Additionally, a letter that is poorly or incorrectly drafted may reduce the likelihood of an efficient resolution, as the other party will not take the dispute seriously and you will then be put to more effort or expense to progress the dispute.

How much does it cost to issue a legal letter?

At Odyssey Legal, one of our core values is transparency, whether it relates to costs or any other aspect of your matter.

For a legal letter, whether it is a letter of demand, a cease-and-desist letter or a response to the other party (or their lawyer), we estimate our fees to be $1,815.00 (incl. GST), being three (3) hours at our hourly rate of $605.00 (incl. GST) to review all of the documents and information provided to our office, consider your specific and legal circumstances, draft a letter, work with you to finalise the letter (so you are happy with it) and issue it to the other party.

How long will it take to draft and issue the letter?

Whilst the time it takes to draft can vary depending on the complexity of the dispute and the amount of documentation to be reviewed and considered, we aim to have the letter drafted and sent to you for your review, within a couple business days.

What if the other party does not respond?

Unfortunately, the legal letters are still only letters, and there is no legal requirement for the other party to acknowledge the letter or respond. This means that you will need to progress this matter to legal proceedings.

However, if legal proceedings are required, then the letter can be relied upon to demonstrate your attempts to resolve any dispute without the need for legal intervention and argue that the other party should be liable for your costs.

Do I need to commence proceedings if I issue a legal letter?

No, there is no requirement for you to commence proceedings after you issue a legal letter, unless you want to progress the dispute. This is an entirely discretionary decision for you to make, upon considering all the relevant variables.
